Important risk notice. Digital-asset trading can result in the loss of all funds allocated to a trade or strategy. Blockchain transactions are generally irreversible. QZAR uses Privy Wallet infrastructure, with server authorisation to request signatures and private-key exports, and may submit transactions under the instructions you approve, including while you are offline. Use a dedicated trading wallet, protect your recovery material, and review all active orders and fee settings.
1. Agreement, definitions and scope
These Terms of Use (the Terms) govern your access to qzar.io, the official QZAR Telegram bot, the Telegram Mini App, QZAR's web application (including its installable progressive web app, or PWA, mode), the QZAR documentation and other QZAR interfaces expressly linking to these Terms (together, the Services). In these Terms, QZAR, we, us and our refer to the provider of the Services operating under the QZAR name. You can contact us using the details in Section 25. The installed mode provides access to the same web application and is covered by these Terms.
A Wallet is a blockchain address together with the signing credentials or permissions required to control it. A QZAR Account is an account, profile or authenticated session created for access to the Services. A Transaction is an instruction submitted to a blockchain or third-party protocol. Automated Instructions include standing, scheduled or conditional instructions that QZAR attempts to execute under your settings. Digital Assets means the supported crypto-assets and tokens available through the Services.
By selecting an acceptance control, creating or using a QZAR Account after the Terms are presented, or otherwise using a Service after a reasonable opportunity to review these Terms, you accept the Terms to the extent legally permitted. If acting for an organisation, you warrant that you may bind it. If you disagree, do not use the Services.
Read our separate QZAR Privacy Policy, which explains personal-data processing. It is incorporated by reference for notice and consistency, but your acceptance of these Terms is not a substitute for separate consent where law requires consent. In a conflict about personal-data handling, the Privacy Policy and applicable data-protection law govern.
2. Current product and limitations
QZAR supplies interfaces and related software for spot digital-asset research and trading, account and wallet management, portfolio information, market information, public profiles and rankings, tournaments, referral and reward features, and available conditional or automated orders. Functionality and supported networks may differ among the Telegram bot, Mini App and web application, including its installed mode. A feature shown in documentation, a preview or a roadmap is available only if enabled in the applicable interface and location.
These Terms do not represent that QZAR currently offers perpetual contracts, futures, margin lending, prediction markets, social-network publishing, user trading theses or other unlaunched features. Any materially new service may require new or supplementary terms, disclosures and regulatory review before release. The Services are not a deposit, bank account, brokerage account or guarantee of liquidity.
QZAR interacts with third-party decentralised exchanges (DEXs), liquidity pools, launchpads, blockchain networks (currently including Solana), validators, RPC services, routing providers, block engines and smart contracts. Those third parties are not controlled by QZAR merely because they can be accessed through a QZAR interface. Their separate rules and risks apply. QZAR remains responsible for its own acts and omissions to the extent required by law.
Regulatory requirements depend on the functions actually performed, the authority exercised over Wallets and transactions, and the jurisdictions in which the Services are provided. Any applicable exclusion for activities limited to software development or technical infrastructure applies only where its legal conditions are met. Describing a Service as software or non-custodial, or incorporating its provider in a particular jurisdiction, does not by itself establish that exclusion. Availability may be limited, suspended or changed to comply with law.
We may engage separate software developers, hosting providers and other technical service providers. Providing development or technical services does not, by itself, make a provider your contractual counterparty. We remain responsible for our obligations under these Terms, including functions performed on our behalf. Each person's legal and regulatory responsibilities depend on the activities and authority they actually exercise; a development or outsourcing arrangement does not remove obligations imposed by applicable law.
3. Eligibility, restricted access and sanctions
You must be at least 18 years old and have legal capacity to enter this agreement. You warrant that you have authority over the Wallets and Digital Assets you use, that the assets derive from lawful activity, that you will comply with applicable law and tax obligations, and that your use does not breach sanctions or other applicable restrictions.
You may not use the Services where offering or using them would violate applicable law, export restrictions, financial sanctions or restrictions on crypto-asset services. You may not use the Services if you are a person with whom QZAR is legally prohibited from dealing, including a person subject to applicable asset-freeze or dealing restrictions, or an entity whose ownership or control causes those restrictions to apply.
For business and risk reasons QZAR also restricts access from the following locations, whether or not each location is subject to the same sanctions regime: Crimea, Cuba, Donetsk, the Democratic Republic of the Congo, Iran, Libya, Luhansk, Myanmar, North Korea, Sudan, Venezuela and Yemen. This is QZAR's contractual availability policy, not a claim that each territory is under comprehensive sanctions. We may update the published list in response to legal or operational changes. The list is not exhaustive of jurisdictions where access would be unlawful.
Do not use a VPN, proxy, false account information or intermediaries to misrepresent your location, identity or eligibility or circumvent restrictions. We may apply proportionate screening and risk controls. A particular feature or applicable law may require additional eligibility or identity checks, with any associated personal-data processing described in the Privacy Policy. If required checks cannot be completed, or required authorisation is unavailable for a user, activity or location, we may refuse or discontinue the affected access. These Terms do not guarantee that every feature will remain available without identity verification.
4. Accounts, authentication and access security
Some Services require a QZAR Account. You are responsible for the accuracy of information you provide and for the security of your Telegram account, relevant login method, devices, browser sessions, PIN, recovery materials and other authentication factors. The web interface offers email-code, Google and Telegram sign-in using Privy verification where configured, and then issues a QZAR application session. Telegram Mini App access can use verified Telegram launch data. A first Wallet can be provisioned as part of account entry. Linked methods identify the same account only after the supported verification flow. Do not assume accounts or Wallets are linked across interfaces unless the application confirms the link.
Google Sign-In is an optional authentication method verified through Privy. Google authorisation verifies account access; it does not itself grant authority to trade or manage Wallets, which is governed by your QZAR instructions and Sections 5 and 7. The Google Sign-In section of our Privacy Policy explains the Google data involved, its use, sharing and retention, and how to remove the connection or request deletion. Removing a Google connection does not itself close a QZAR Account, end existing QZAR sessions or cancel Automated Instructions.
You must not share credentials or allow unauthorised persons to use your account. Tell us promptly via the official contact channel if you suspect compromise. We may limit logins, require re-authentication or suspend functions to investigate suspected misuse or protect the Services.
The Telegram bot uses a Wallet-export PIN; sensitive web actions require an authenticator code when enabled, or otherwise fresh sign-in proof. These protections differ by interface and do not require a new approval for each enabled automated trade. A QZAR PIN, authenticator code, device lock or session control is not the Wallet's private key and does not revoke an exposed key. If a private key or recovery phrase has been compromised, create a new Wallet and transfer assets as appropriate. We will never ask you to disclose recovery material in an unsolicited support message.
You authorise instructions validly submitted through your authenticated account, subject to the security obligations and liability rules imposed on QZAR by law. You do not assume responsibility for unauthorised actions caused by QZAR's own breach merely because they originated through an account associated with you.
5. Embedded wallets, credentials and signing authority
QZAR uses Privy for Wallet creation, import, key infrastructure and signing. Solana Wallets are created or imported with QZAR's server authorisation key as the configured Privy owner. QZAR stores public addresses and Privy wallet identifiers and can request signatures and private-key exports through Privy. QZAR therefore has technical signing and export capability; using Privy does not mean all signing takes place on your device or only you can request key access. Here, "owner" describes an authorisation configuration, not QZAR ownership of your assets.
You retain your rights in assets held at the relevant blockchain address, subject to blockchain rules, third-party protocols and permissions you grant. You expressly authorise QZAR, only to provide functions you request, to create or import a Wallet through Privy, handle import/export material as technically required, request signatures and submit transactions under your selected settings. This does not authorise QZAR to trade for its own account with your assets, lend, pledge or rehypothecate them, or initiate unrelated transactions. Technical capability does not expand the contractual authority you grant.
Where available, the bot accepts a supported recovery phrase or private key; the web import flow accepts the private-key formats stated in that interface. Import material passes through the QZAR systems handling that flow before the key is imported into Privy. An authorised export retrieves a plaintext private key through QZAR and displays it in the relevant interface. Telegram bot conversations are not end-to-end encrypted Secret Chats. Use only the verified import/export flow. Never send a key, phrase, PIN or authenticator secret to support, an ordinary chat or an unverified bot.
Export requires the security check for the interface: the bot's PIN, or the web application's authenticator code when enabled and otherwise fresh sign-in proof. Export does not delete the Privy wallet, rotate its key, revoke QZAR's server authorisation, or cancel standing orders. Removing a Wallet from QZAR's list is not evidence of any such revocation. Keep a verified independent backup before funding or requesting removal. Neither QZAR nor Privy guarantees recovery of a lost account or backup.
To withdraw standing trading authority, cancel affected orders and copy/auto-trade settings, review their status, and contact [email protected] for account closure or provider-side key-access requests that lack a dedicated control. Signing out, ending sessions, unlinking a login method and uninstalling the PWA do not cancel automation. An exposed private key is not revoked by changing a PIN; moving assets to a fresh independently controlled Wallet may be necessary. Privy availability or authorisation failures may prevent signing, export and withdrawals through QZAR even when the blockchain remains available.
Section 19 governs suspension and termination of authority for future submissions. Transactions already released to a network may complete. Key deletion or provider-side revocation must be confirmed through the applicable procedure; these Terms do not represent that deleting a database record automatically deletes a Privy key. See Privy's user terms and privacy notice for its services where applicable; those notices do not replace QZAR's obligations.
6. Trading, routing and blockchain settlement
When you submit a trade, you instruct QZAR to prepare, route and/or submit a blockchain transaction using your chosen Wallet, asset, amount, route and execution settings. Check the token and pool contract addresses, network, source and destination assets, amount, price estimates, slippage, fee settings and any token transfer restrictions before you approve the instruction. A token name, symbol or visual branding can be misleading.
Quotes, estimated outcomes and interface status messages are indicative unless expressly stated otherwise. Liquidity, routing, pool composition, MEV, network congestion, validator behaviour and third-party failures can affect execution, value received or transaction finality. Network confirmation, rather than a UI message alone, should be used to verify whether a trade completed. Repeating an apparently unsuccessful transaction can create a second transaction.
Blockchain transactions may be public, irreversible and subject to fees even when an instruction fails. QZAR cannot reverse transactions confirmed by a network or recover assets sent to incorrect addresses by command. We do not guarantee that any token can be traded, withdrawn or sold after acquisition.
If you select multiple Wallets or a Wallet group, the amount shown or specified per Wallet applies to each selected Wallet unless the interface expressly identifies it as a combined total. Each transaction may execute, fail, incur costs and settle independently. Review the aggregate exposure across the group.
7. Conditional and automated orders
Available Automated Instructions may include classic, DCA, TWAP, range-confirmation and trailing orders, price- or market-cap-based triggers, take-profit and stop-loss conditions, auto trade, copy trading and sniping and other strategies if enabled. A displayed feature name does not guarantee that all order types, schedules or settings are available in every interface. An Automated Instruction can trigger and execute while you are offline or the app is closed, without a new approval for each transaction.
By enabling an order you give standing authority, limited to the selected Wallets, amounts, trigger conditions, expiry, routes, allowed tokens, fees and risk controls, for the system to attempt the specified transactions. This authority continues until the order completes, expires, is effectively cancelled or is disabled by QZAR. Creating a conditional order does not reserve your funds. You must maintain sufficient available assets and network-fee balances at the time of execution.
A limit or market-cap trigger is a condition for attempting a transaction, not a guarantee of the final execution price or execution at all. Stop losses and trailing conditions do not guarantee a loss ceiling. Orders may be rejected, delayed, skipped, only partly filled where supported, or executed at different prices because of liquidity, market movement, slippage tolerances, network conditions or other execution constraints. A take-profit or stop-loss linked to an entry may remain pending independently once the entry completes.
You can request cancellation using an available order-management control. Cancellation is not complete merely because you close the interface, disconnect Telegram, export a key or move a Wallet between groups. Cancellation cannot reverse a transaction already signed and irrevocably submitted or settled. You must review the displayed per-Wallet status and on-chain evidence. Orders may continue to attempt execution until the cancellation has been processed.
Strategy-specific instructions. DCA and TWAP can submit repeated trades according to configured schedules; check whether the amount is per execution and per Wallet, along with run limits and expiry. Range confirmation and trailing conditions can delay, move or reset a trigger according to the selected rule. Auto Trade can submit a trade when a qualifying token or pool address is entered or opened under the enabled configuration; it is separate from scheduled averaging. Saving a strategy, starting it and stopping it are distinct actions where the interface provides them. Changing or stopping a copy strategy does not itself close positions already acquired. Sniping filters and submission priority do not verify a launch or guarantee an early purchase.
If copy trading is available, you choose the observed address and your own risk parameters. The observed Wallet's owner is independent of QZAR; their transactions, motives, identity and history may be unknown or misleading. Differences in latency, balances, liquidity, fees and route mean you may receive different results. Displaying or monitoring a Wallet does not imply QZAR verifies or endorses its owner. The user must monitor orders and exposures.
We may pause or disable automation where necessary for maintenance, security, abuse prevention, technical integrity or compliance, subject to applicable law. No system guarantees continuous execution, price monitoring or notifications. You remain able to use any independent Wallet access you possess, subject to protocol rules, to secure assets.
8. Telegram and web access
The Telegram bot and Mini App rely in part on Telegram's client, account environment, platform policies and connectivity. Using the Mini App may transmit Telegram authentication or session data to QZAR and Telegram as described in the Privacy Policy. Telegram's own terms and privacy notice separately apply to its services. A failure, suspension or change by Telegram may affect access to QZAR functions.
The web application operates through supported browsers and, where offered, can be installed on your device or added to its home screen in PWA mode. This is a way to use the same web application. It may keep you signed in and store application files and preferences on your device. Installing the web application does not create a Wallet backup or guarantee offline trading; uninstalling it does not cancel active orders. Review browser and device settings to manage stored data and permissions.
Where you enable supported Web Push notifications, QZAR stores your subscription details and sends trade/order updates through your browser's push service. A message can reveal a token or trading action on a lock screen; control previews and permissions on your device. Notifications can be delayed, duplicated or absent and are not an order-cancellation or risk-control mechanism. Browser/site permissions and a separate subscription-removal request may be needed to stop delivery. Other device capabilities are used only where a feature is available and appropriate permissions or notices are provided. Declining an optional device permission may limit that feature but does not waive your legal rights. Platform differences may mean that a setting or order created on one interface is not shown on another until the data synchronises; verify order status before issuing an additional instruction.
9. Fees and other execution costs
Unless a different rate is prominently disclosed for a relevant trade before you approve it, the standard QZAR trading fee is 1% of each completed buy or sell. No separate subscription is required for the standard bot functionality described in current QZAR documentation. The transaction interface or associated fee disclosure controls the specific fee for a supported transaction. Automated orders use the QZAR fee terms disclosed when the instruction is enabled.
Network transaction fees, priority fees, tips (including any block-engine or validator tips), liquidity-pool or launchpad fees and other third-party charges are distinct from QZAR's trading fee. Slippage is an accepted price-deviation setting, not a separate QZAR fee; price impact can also change the value received. Fees and estimates can vary before settlement. A failed on-chain transaction may still incur network or priority charges even if no percentage QZAR trading fee becomes payable.
QZAR may amend its trading fee prospectively with reasonable notice under Section 20. An increase to QZAR's fee does not apply to an already-enabled Automated Instruction without your affirmative acceptance; where necessary we may pause the instruction rather than apply an unapproved increase. Independently variable third-party network and protocol costs remain subject to your execution controls and network conditions.
Fees validly collected for completed transactions are generally not refundable, except where a charge was incorrect, we agree otherwise, or applicable law requires reimbursement. No provision excludes QZAR's responsibility for its own errors or unlawful charges.
10. Referral program, points, cashback and tournaments
Where available, QZAR's program may provide rewards from eligible referred users' completed trading activity and cashback calculated on your own eligible QZAR trading fees. The present standard referral shares are 35% (level 1), 3% (level 2) and 2% (level 3) of the corresponding eligible QZAR fee actually collected. Cashback levels currently reach up to 25% of eligible QZAR fees; the percentage depends on program eligibility and points. Rewards are not percentages of trading profit or total trading volume.
Current documentation provides for 10 points per USD 1 of eligible USD-equivalent trading volume, with tier thresholds, referral-linked benefits and supported reward assets explained in the relevant program interface. The current default pending period before a reward is claimable is 12 hours, but the actual claimable status and the program terms shown for that accrual control; a displayed pending balance is not an immediately withdrawable balance. Rewards may be calculated and delivered in supported Digital Assets whose market value can fluctuate. Network costs may be deducted from the claimed payout; a balance too small to cover costs may remain unclaimed.
A valid referral association is established through supported referral mechanics; the first valid association generally remains fixed. You must not create or control accounts for self-referral, manipulate volume, engage in wash trading, or use misleading promotional claims. Comply with applicable advertising disclosures when you receive compensation for a referral. We may investigate abuse, correct mistakes, withhold disputed amounts pending review and cancel fraudulent or ineligible rewards; we will provide an appropriate route to challenge an adverse determination.
Tournaments and promotional boosts. Where enabled, entry can depend on the published registration window, referral relationship, minimum Wallet balance or other disclosed eligibility criteria. Qualifying volume, token exclusions, minimum trade size/count, referral-volume attribution, scoring periods, point/cashback boosts, ranking and prize allocation are determined by the specific event rules. Participation can expose your profile and competition statistics publicly as described in the Privacy Policy. A live ranking or estimated prize is provisional until valid results and settlement are confirmed; a boost is not automatically cumulative with every other promotion. Do not trade merely to increase a rank. Before entry, event rules must state the organiser, dates, eligible locations, scoring, tie treatment, prize asset and pool calculation, payout/claim conditions and treatment of interrupted or cancelled events. Where adequate event rules or a lawful offering are unavailable, the event must not be offered for entry. No tournament guarantees a profit or reimbursement of trading losses.
Material changes to program terms will apply prospectively with notice where reasonably practicable. We will not arbitrarily extinguish valid accrued rewards, although they remain subject to the rules in effect when earned, law, sanctions, fraud review and technical claims conditions. Points have no independent cash or token value unless a specific feature expressly grants one. Tax on rewards is your responsibility where applicable.
11. Market data, analytics, profiles and information
The Services may display token, liquidity, price, trading-volume, market-cap, Wallet, order, portfolio and profit-and-loss information obtained from blockchains and third-party data sources or calculated by QZAR. Such information can be delayed, inaccurate, stale, incomplete or affected by data outages, pricing assumptions, suspicious token behaviour or the absence of off-chain transactions.
Profiles, portfolios, search and rankings. Profile and portfolio pages are available to visitors without requiring sign-in. Profile identifiers, including initially assigned values, and available biography or image fields can be public. A profile or associated-Wallet lookup can expose the account association, other supported Wallets linked to it, balances, positions, trading history and profit-and-loss estimates. Do not assume these data require a separate publication action or that all Wallets in one QZAR Account remain unlinkable. Search by Wallet address can associate a public address with a QZAR profile; leaderboards can expose points, volume, trade counts, rank, estimated prizes and available signal statistics. Do not add confidential information or another person's image without authority. Publication of a profile, ranking or tracked public Wallet does not verify identity, ownership, performance, expertise or willingness to have trades copied. Privacy rights and any applicable objection process remain available.
Display of an asset, Wallet, trade route, statistic, risk indicator or third-party project is not verification, endorsement, a warranty of legitimacy, or an invitation to buy. Research outputs, alerts and presets are informational tools rather than personalised recommendations. Independently check important information, particularly contract addresses and the final transaction details.
12. No personalised financial, legal or tax advice
QZAR does not provide personalised financial, investment, legal or tax advice through the functions described in these Terms. Content, alerts and automated tools should not be interpreted as a personalised recommendation or suitability determination. You decide whether, when and how much to trade, and you should seek appropriately qualified advice if needed.
No clause in these Terms asserts that QZAR is exempt from financial regulation or that a regulator has approved QZAR. If the actual performance of the Services requires regulated permissions, the relevant legal obligations apply regardless of the contractual description. We may limit services while those requirements are assessed or satisfied.
13. Prohibited activity
You must not: (a) engage in fraud, theft, money laundering, terrorist financing, evasion of sanctions or other unlawful conduct; (b) manipulate markets, including by wash trading, spoofing, artificial volume or pump-and-dump schemes; (c) exploit vulnerabilities, deploy malware, access another person's account or information without authorisation, interfere with availability or evade security controls; (d) use unauthorised scraping, automated requests, bots or scripts that bypass access restrictions, extract substantial QZAR data or overload our infrastructure; (e) impersonate QZAR or misleadingly claim endorsement; (f) misuse referral rewards or cause others to breach these Terms; or (g) infringe intellectual-property, privacy or other rights.
QZAR's built-in bot, Mini App functions, authorised APIs (if any), supported integration and trading automation are not prohibited merely because they are automated. Security research requires authorisation before testing; report suspected vulnerabilities without copying, retaining or exposing users' data.
14. Intellectual property, branding and feedback
QZAR and its licensors retain rights in our software, original content, documentation, visual design and trademarks. We grant you a limited, revocable, non-exclusive licence to access and use the Services lawfully under these Terms, including the supported trading features. Rights under applicable open-source licences and non-waivable law are unaffected. You receive no ownership interest in QZAR technology or another user's content or assets.
You may not sell access to, distribute, sublicense, reverse-engineer or reproduce substantial protected parts of the Services without permission, except where law or a relevant licence permits it. QZAR names and marks must not be used to imply sponsorship or official status. You may use official referral materials only within their stated rules.
For profile text, images and other material you choose to submit, you grant QZAR a non-exclusive licence to store, resize, display and transmit that material only as reasonably needed to provide and moderate the requested feature. You retain your rights and must have permission to submit it. We may restrict unlawful, infringing or abusive material, with review available through [email protected], subject to applicable law. This licence does not authorise unrelated advertising use or override deletion and privacy obligations.
Suggestions you voluntarily provide may be used by QZAR under a non-exclusive, worldwide, perpetual, royalty-free licence to improve our products; this does not authorise publication of personal information in your support request or override privacy obligations.
15. Third-party services and links
Third-party websites, Privy Wallet and authentication infrastructure, Telegram, Google sign-in, browser push services, blockchain networks, Wallet software, DEXs, smart contracts, bridges, analytics providers and transaction infrastructure operate under their own rules and data practices. We do not guarantee their availability, security, legality, token listings or economic outcomes. Third-party links do not imply endorsement. You should read their policies and verify destinations before connecting a Wallet or approving a transaction.
QZAR remains responsible for failures, misrepresentations or data processing attributable to QZAR under applicable law, including where service providers act on our behalf. These Terms do not waive claims that cannot lawfully be waived.
16. Privacy and communications
Our separate Privacy Policy explains account and transaction data, Privy Wallet and authentication processing, import/export material, public profiles and rankings, tournament eligibility, analytics, Web Push, Telegram Mini App authentication, web/PWA storage, suppliers, transfers, retention and your rights. It may change under its own update section. We will seek separate consent for optional processing where required.
We may provide transaction and account notifications, security messages, material terms updates and legally required notices through the QZAR interfaces or verified contact channels. Marketing notifications are subject to applicable consent and opt-out requirements. A notification failure does not change the finality of a blockchain transaction.
17. Risks and security disclosures
Digital Assets can be volatile, illiquid, fraudulent or technologically defective. Risks include complete loss of trading capital; compromised Wallet keys, PINs or sessions; malicious or mutable token contracts; blocked sales or transfer taxes; smart-contract flaws; network instability; forks; token freezes; inaccurate prices; validator and RPC failures; MEV; front-running; unexpected slippage; execution delays; and trading automation operating without your presence. Trading outcomes may differ materially from displayed estimates, model outputs and historical results.
Use a dedicated trading Wallet and only amounts you can afford to lose. Independently maintain backup and transaction records. No security measure eliminates all risks. Under Section 18 and applicable law, QZAR is not the guarantor of market performance, third-party protocols or assets that you select, but this warning does not excuse QZAR's own legally actionable failures.
18. Service warranties and liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT A GUARANTEE OF CONTINUOUS ACCESS, ANY PARTICULAR RETURN, EXECUTION PRICE, TRANSACTION SUCCESS, DATA ACCURACY OR FITNESS FOR A PARTICULAR TRADING STRATEGY. WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED REMAIN IN FORCE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QZAR IS NOT LIABLE FOR LOSSES THAT ARE SOLELY ATTRIBUTABLE TO MARKET MOVEMENTS, YOUR VOLUNTARY TRADING INSTRUCTIONS OR THE ACTS OF INDEPENDENT THIRD PARTIES AND THAT DO NOT RESULT FROM A BREACH OR OTHER LEGALLY ACTIONABLE CONDUCT BY QZAR. WE DO NOT EXCLUDE LIABILITY FOR AN INCORRECT QZAR CHARGE, A VALID ACCRUED REWARD OBLIGATION, OR RESPONSIBILITY THAT APPLICABLE LAW PLACES ON US FOR OUR SOFTWARE, SECURITY OR OTHER CONDUCT.
FOR USERS ACTING IN THE COURSE OF BUSINESS ONLY, QZAR WILL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSS OR LOST BUSINESS OPPORTUNITIES TO THE EXTENT PERMITTED BY APPLICABLE LAW. THIS EXCLUSION DOES NOT REMOVE NON-WAIVABLE RIGHTS OR THE EXCEPTIONS SET OUT BELOW.
NOTHING EXCLUDES OR RESTRICTS LIABILITY FOR FRAUD, WILFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY OTHER LIABILITY, REMEDY OR MANDATORY CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. NO CONTRACTUAL TIME LIMIT SHORTENS A NON-WAIVABLE STATUTORY LIMITATION PERIOD.
19. Suspension, termination and Wallet exit
You may stop using a Service and request account closure. Before closure, review and cancel pending instructions, export any Wallet keys you need and/or move funds to a Wallet you can access independently. Do not assume removal of a PWA, closure of a browser or blocking of a Telegram bot cancels orders or moves funds.
QZAR may suspend or restrict access to address security incidents, suspected abuse, unlawful use, sanctions, an unavailable service dependency or another material legal or operational risk. We may also discontinue functions on reasonable notice where practicable. We will communicate reasons and a route to review where lawful and appropriate.
Suspension or termination of trading access prevents QZAR from initiating new automated transactions under the affected instructions; termination revokes QZAR's ongoing authority for future submissions. We will disable the affected unsubmitted instructions in systems we control. Transactions already transmitted or irrevocably released for settlement may complete. Where lawful and technically practicable, we will provide a reasonable opportunity to export keys and retrieve account records, subject to security controls. We cannot promise that your assets remain accessible through QZAR after access ends; retain independent Wallet access.
Closure does not reverse blockchain transactions, erase public blockchain records, transfer ownership of your assets to QZAR, or cancel valid accrued rewards except under disclosed eligibility rules or applicable law. Personal data, Privy wallet references and provider-held key access are addressed under the Privacy Policy and legal requirements. Closure may require support assistance and provider-side action; there is no promise of an automatic end-to-end deletion control. We must verify the affected instructions and authorisations rather than treat a removed Wallet record or signed-out session as proof of revocation. Obligations intended to survive termination remain in effect.
20. Changes, interruptions and notices
We may update these Terms for legal, security, product or operational reasons and will post a revised version and effective date. For material adverse changes, we will give reasonable advance notice through the Services or an available contact method unless urgent law or security demands otherwise. Where a fresh acceptance or other consent is required, we will obtain it. Amendments do not retroactively modify fees on completed trades or valid accrued rewards.
We may suspend or modify functionality, routes, networks, integrations and supported assets to protect security or comply with law. We aim to provide appropriate notice when practicable. Past or planned features do not create a contractual guarantee of future release.
21. Applicable law, complaints and disputes
Contact [email protected] first with a description of the problem, relevant Wallet address and transaction identifiers (never send a private key or seed phrase). We will aim to respond and engage in good-faith resolution. A 30-day informal-resolution period is encouraged, but it does not prevent urgent judicial relief, regulator complaints or action needed to preserve a legal time limit.
The governing law and courts with jurisdiction are determined by applicable conflict-of-laws and jurisdiction rules, including mandatory consumer protections. These Terms do not require exclusive jurisdiction in a particular court or impose mandatory pre-dispute arbitration, a class-action waiver, a jury-trial waiver or a shortened statutory claims period. Nothing removes rights to bring proceedings in a court available to you under mandatory law.
Nothing limits a person's right to contact law enforcement, a financial regulator, a data-protection supervisory authority or other body where such a right cannot be waived.
22. Taxes and records
You are responsible for determining and meeting your applicable tax obligations and maintaining your records of trades, rewards and Wallet activity. We may keep or disclose records to meet obligations applicable to QZAR, and may apply legally required withholding or reporting. Portfolio estimates are not a complete tax statement.
23. Transfers, severability and entire agreement
You may not assign rights under these Terms without our consent, except where applicable law allows. Subject to applicable law, we may transfer this agreement to a successor that expressly assumes the obligations it takes over. We will publish the successor's details and the effective date of the change in Section 25 and notify affected users as required by law and Section 20. We will obtain any consent or acceptance required for the transfer. A change of service provider or service name does not by itself release the previous provider from existing obligations or reduce your mandatory rights.
If part of these Terms is unenforceable, the remaining provisions continue to the extent consistent with law and the agreement's purpose. A delay in enforcing a right is not a general waiver. These Terms, the separate Privacy Policy in its capacity as a notice, and additional conditions expressly disclosed for a supported feature comprise the governing documentation. Feature-specific conditions prevail for their subject only when clearly identified and consistent with mandatory law. Nothing excludes liability for fraudulent misrepresentation.
24. Languages, accessibility and support
The English text is the reference version unless mandatory local law requires another version. We may publish translations for convenience and will address discrepancies as required by applicable law.
